About Mochi

Mochi is a private space that helps families stay connected through small daily moments, including check-ins, messages, nudges, and notifications. Mochi is provided by Hestvera, a California sole proprietorship owned by Zhicong Zhong.

Eligibility and family circles

You may use Mochi only if you can form a legally binding agreement where you live. Mochi is designed for adults, and family circles may include people under 21. If a minor participates in a family circle, the parent or legal guardian responsible for that minor must make sure the use of Mochi is appropriate and authorized.

You are responsible for the information you provide, for keeping your account access secure, and for inviting only people you are authorized to invite. Do not create an account for another person without their permission or the permission of their parent or legal guardian where required.

Accounts and verification

Mochi may use your mobile phone number to verify your account, send one-time verification codes, deliver invitations, and communicate service-related notifications. You agree to provide accurate information and to keep your phone number current.

You may not share access to your account, use another person's account without permission, or attempt to bypass our authentication or security controls. Tell us promptly if you believe your account or phone number has been used without authorization.

Sharing and family visibility

Mochi is built around family circles. Information you share may be visible to the family members or recipients selected through the service. You are responsible for choosing what to share and with whom.

Family-circle owners and members may have different controls over invitations, membership, notifications, and shared content. Hestvera does not control the decisions families make about whom to invite or what they share with each other.

Your content

You retain your rights in the text, check-ins, notes, photos, voice notes, and other material you submit through Mochi. You grant Hestvera the limited license needed to host, store, transmit, display, and otherwise provide that content to you and the family members or recipients you choose.

You represent that you have the rights and permissions needed to share your content. Do not share content that is unlawful, threatening, abusive, invasive of another person's privacy, or that infringes someone else's rights.

Permissions and notifications

Mochi may request access to device features such as notifications, photos, microphone, location, or activity information for specific features. You can accept or decline permissions and may change them through your device settings. Some features may not work if the permission they require is unavailable.

Notifications, SMS messages, and other communications may be delayed, blocked, or unavailable because of carrier, device, connectivity, permission, or third-party service issues.

Acceptable use

You agree not to:

• Use Mochi for unlawful, fraudulent, abusive, threatening, or harmful activity.
• Harass, impersonate, stalk, monitor, or intimidate another person.
• Access a family circle, account, or content without authorization.
• Upload malware or attempt to interfere with the service or its security.
• Reverse engineer, scrape, copy, resell, or exploit Mochi except as permitted by law.
• Use Mochi as a substitute for emergency services, medical care, or professional caregiving.

Not medical or emergency care

Mochi is not a medical service, medical device, emergency-response service, fall-detection system, or professional monitoring service. Check-ins, mood selections, activity information, and missed-check-in notifications are intended only as informal family-connection tools.

Mochi does not diagnose, treat, prevent, or monitor any medical condition and does not guarantee anyone's safety or wellbeing. Do not rely on Mochi for an emergency. If you believe someone is in danger or needs immediate help, contact local emergency services or the person directly.

Privacy

Our Privacy Policy explains what information Hestvera collects, how it is used, how it is shared, and the choices available to you. Hestvera does not sell personal information or use Mochi content for targeted advertising.

Third-party services

Mochi may rely on third-party services for hosting, databases, storage, authentication, SMS, notifications, analytics, security, or other infrastructure. Those services may have their own terms and privacy policies. Hestvera is not responsible for third-party networks, carriers, devices, operating systems, or services that are outside our control.

Availability and changes

We may modify, suspend, or discontinue part or all of Mochi at any time. We may also update features, permissions, supported devices, or notification behavior. We will make reasonable efforts to provide notice of material changes when appropriate.

We do not promise that Mochi will always be available, uninterrupted, secure, or error-free. You are responsible for maintaining a compatible device, connection, and current operating system.

Intellectual property

Mochi, Hestvera, and the related names, logos, software, designs, text, and features are owned by or licensed to Hestvera and are protected by applicable intellectual-property laws. These Terms give you a limited, personal, non-transferable right to use Mochi while you comply with them.

Suspension and termination

You may stop using Mochi at any time. Hestvera may suspend or terminate access if we reasonably believe that you violated these Terms, created risk for another person or the service, engaged in unlawful activity, or if continued operation is no longer practical.

When access ends, your right to use Mochi ends. Some provisions, including those concerning content, intellectual property, disclaimers, limitations of liability, and dispute resolution, will continue to apply.

Disclaimers

To the maximum extent permitted by law, Mochi is provided “as is” and “as available,” without warranties of any kind, express or implied. Hestvera disclaims warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, and uninterrupted availability.

Limitation of liability

To the maximum extent permitted by law, Hestvera will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, content, goodwill, profits, or access arising from or related to Mochi.

Nothing in these Terms limits liability that cannot lawfully be limited or excluded under applicable law.

Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Hestvera and its owners, contractors, and service providers from claims, losses, liabilities, and expenses arising from your misuse of Mochi, your violation of these Terms, or your infringement of another person's rights.

Governing law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Any dispute will be handled in the courts located in California, unless applicable law requires a different forum or process.

Changes to these Terms

We may update these Terms from time to time. When we make a material change, we will update the effective date and provide notice through Mochi or another reasonable method. Your continued use of Mochi after the updated Terms become effective means you accept the changes.
